Ontario's primary vaping legislation is the Smoke-Free Ontario Act, 2017, amended in 2020 with provisions specific to vaping products. Here is exactly what Ontario law says for 2026.
Legal Vaping Age in Ontario
In Ontario, you must be 19 years old or older to purchase, possess, or use vaping products under the Smoke-Free Ontario Act. Retailers must check ID for anyone appearing under 25. Selling to minors carries significant penalties and licence revocation.
Where Can You Vape in Ontario?
Under the Smoke-Free Ontario Act, vaping is prohibited wherever smoking is prohibited:
- All enclosed public places: restaurants, bars, malls, offices, workplaces
- Common areas of multi-unit residential buildings
- Grounds of schools, hospitals, childcare facilities, and universities
- Within 20 metres of playgrounds and publicly owned sports areas
- On public transit vehicles and in transit shelters
- In vehicles when a person under 16 is present
