- Helping verify proof of purchase
- Facilitating communication or submission where operationally feasible
Such assistance is administrative only and does not constitute:
- An assumption of manufacturer obligations
- A guarantee of warranty approval
- A promise of replacement, repair, or refund
Final warranty decisions, including approval, rejection, replacement type, or timelines, remain entirely at the manufacturer’s discretion.

Overview
The Lush Vape Extended Warranty Plan (“Extended Warranty Plan” or “Plan”) is an optional, fee-based protection plan that provides store-supported replacement coverage for eligible products that experience a verifiable functional defect during normal and intended use.
The Plan is intended to supplement, and does not replace or modify, any applicable manufacturer warranty. -
Coverage Duration
The Extended Warranty Plan is valid for sixty (60) days from the original date of purchase, as indicated on the customer’s receipt or order confirmation.
The Plan is available only for select products sold by Lush Vape and must be purchased at the time of sale. Coverage cannot be added retroactively. -
Covered Defects
Subject to the terms and conditions of this Plan, coverage applies where an eligible product develops a functional defect under normal, intended use within the coverage period.
Covered defects may include, but are not limited to:- Failure to power on or activate
- Battery malfunction or failure to charge when used with compatible charging equipment
- Auto-draw, firing mechanism, or activation sensor failure
- Consistent failure to produce vapor during normal operation
- Internal electrical or component failure attributable to manufacturing defects
Coverage applies only where the defect is verifiable, reproducible, and determined by Lush Vape to be consistent with normal use.

Exclusions
The Extended Warranty Plan does not cover defects, damage, or failures resulting from or related to:
- Physical damage, including drops, cracks, dents, or impact
- Liquid damage, leakage, condensation, or exposure to moisture
- Improper charging, use of incompatible charging devices, or electrical misuse
- Use outside the product’s intended purpose or manufacturer guidelines
- Tampering, modification, disassembly, or attempted repair
- Cosmetic wear or normal deterioration that does not affect functionality
- Consumable depletion or expected performance decline
- Loss or theft
- Products that cannot be verified as having been purchased from Lush Vape
- Physical damage, including drops, cracks, dents, or impact

Claim Requirements
To submit a claim under the Extended Warranty Plan, the customer must present:
- The faulty product
- The original packaging, including the box and any included components
- Proof of purchase, including a receipt, order confirmation, or verifiable transaction record
Failure to provide any required item may result in claim denial.

Inspection & Replacement Process
- All claims are subject to in-store inspection and assessment by a Lush Vape representative.
- Devices may be visually inspected and functionally tested to confirm eligibility.
- If a claim is approved, Lush Vape will provide a replacement product at no additional cost.
- Replacements are issued on a like-for-like basis where available. If the identical product is unavailable, Lush Vape may, at its discretion, provide an equivalent replacement of comparable type and value.
- All claims are subject to in-store inspection and assessment by a Lush Vape representative.

Verification & Fraud Prevention
All claims are subject to verification and eligibility review to ensure fair and consistent application of the Plan.
Lush Vape reserves the right to:- Verify purchase records, transaction history and plan eligibility
- Validate product identifiers including SKU, batch/lot number, serial number, packaging identifiers, and internal markings where applicable
- Inspect the product for evidence of misuse, impact damage, liquid ingress, electrical misuse, tampering, or component removal
- Decline claims where the reported defect cannot be verified or reproduced
- Test device functionality to confirm the reported defect
Claims may be denied where:
- The defect is inconsistent with normal use or known manufacturing failures
- The product or packaging has been altered, substituted, or mismatched
- Verification cannot be completed to Lush Vape’s satisfaction
- A pattern of claims suggests misuse or abuse of the Plan
- The item cannot be confidently identified as the original product sold by Lush Vape
- The reported issue cannot be reproduced or verified
- Verify purchase records, transaction history and plan eligibility

Abuse & Misrepresentation
The Extended Warranty Plan is intended to address unforeseen functional defects only, not routine consumption, intentional damage, or replacement of normally depleted products.
Any misrepresentation of product condition, intentional damage, substitution of components, or attempt to obtain coverage outside the intent of the Plan may result in:- Immediate denial of the claim
- Voidance of coverage for the affected product
- Denial of future Extended Warranty Plan coverage, at Lush Vape’s discretion
Lush Vape reserves the right to limit or refuse Extended Warranty coverage where a pattern of claims indicates misuse or abuse of the program.

Limits of Liability
Vaping products sold by Lush Vape are intended for adult use only and must be used strictly in accordance with manufacturer instructions and applicable laws. Lush Vape is not responsible for, and expressly disclaims liability for, any injury, loss, damage, or third-party claim.

- Once a replacement has been issued, the Extended Warranty Plan is considered fulfilled and concluded for that product.
- Lush Vape’s liability under this Plan is limited solely to the replacement of the eligible product, as described herein.
The Extended Warranty Plan is designed for occasional, legitimate defects and is not intended to function as a replacement for consumable usage, user error, or product misuse. Warranties are limited to product functionality and defects as defined in their respective terms. - The Extended Warranty Plan is non-refundable once a claim has been approved or a replacement has been issued.
- If an eligible product is returned in accordance with Lush Vape’s Return Policy and qualifies for return, the Plan may be cancelled with the original transaction, subject to verification.

Delivery Process
Our Same-Day Local Delivery option will automatically appear at Checkout based on your postal. Once your order is processed using Local delivery, you will receive an email notification with a tracking link and an estimated delivery time from our courier partner, FlashBird. You can choose your preferred delivery time using the "Select Delivery Time" option in this email. When your order is out for delivery, FlashBird will notify you via text message, SMS, or email.
To accept your local delivery package, you must present a valid ID and sign for age verification.
If you are unavailable to receive your order, you can reschedule using the "Select Delivery Time" option in the notification email from FlashBird.

Missed your Same-Day Delivery?
In case of a failed delivery attempt, the delivery person may contact you the next day to arrange a second delivery attempt. Please note that we cannot leave packages in mailboxes, with concierges, or unattended at your door— packages must be received in-person and signed for. Additionally, we also do not deliver to PO Boxes.

Failed Delivery Attempts/Unauthorized Returns
An unauthorized return from Canada Post is when a package is sent back to our warehouse due to an unsuccessful delivery attempt. This may be caused by an incomplete or incorrect address or the refusal to accept the order.
Following the receipt of the returns, our customer service representative will contact you within 2-3 business days to process a store credit for the unauthorized returns. You will receive a store credit for your order, excluding the shipping cost.
A flat rate of $20 will be applied to your store credit. For Express Shipping orders, a flat rate of $24.99 will be applied. The E-gift card will be sent to you in a separate email. Please check your spam folder in case you are not able to find the email.
